How to set up the legal structure of a church
This is not intended to be a legal document, but a brief overview of establishing the legal structure of a Church. It is always recommended to consult with a local attorney on tax and legal laws.
What is needed for a church bank account?
• The Church's By-Laws.
• Church Constitution
• EIN.
• 501(c)(3) status certification to prove your church's tax-exempt status.
• Money to fund the opening balance.
Church By-Laws
The Church By-Laws will define the method of governing the church. When drafting your church bylaws, consider the following:
• Why are you establishing a church?
• Statement of Faith
• What constitutes a partner or member of the church?
• How will decisions be made? Pastoral Team, Staff Team, Financial…
• How will leaders be selected? Pastoral Team, Staff Team, Elders, etc…
• Congregational Leadership & Elder Leadership
• How will the Church safeguard and be accountable for finances, property, resources?
• How will meetings be conducted?
• How and when will records and reports be made available?
• Will the church's activities include fundraising programs?
• Furthermore, you also have to prepare a board of directors and a list of officers for your church.
